    Hi guys, I have a unique situation, thanks to july visa bulletin. I have a EB3 labor and I 140 approved with the PD as May 2004. Recently I applied EB2 PERM in order to port the PD from EB3 to EB2. My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.

    Hi ,
    my experience with O visa is that paperwork, presentation, previous track record of the lawyer with USCIS is critical

    so in this case, absorbing the 5000 cost difference may be a good idea

    Of course you can always ask your employer if they are willing to take that hit but as you know you have a 50 % chance there at the best

    So decision is yours

    my i-94 is abt to expire in 7.5 months time... due to passport expiry date, though my H1B is valid for 1+ more year...how soon can i renew my I-94,? I understand i have to renew my passport first in order to get the I-94 renewed.

    Immigration Visa Attorney Blog Has Just Posted the Following:
    The Barack Obama Administration recently announced that border guards at United States Ports of Entry (POE) will begin screening aliens arriving from certain countries based on specific information about threats to the USA. The immigration attorneys at Los Angeles' Fong & Chun immigration law firm are advocates for national security balanced against sensible protections for civil rights. We hope this change will reduce the number of unwarranted, unreasonable, and (usually) unfriendly challenges to certain arriving visitors.

    Since the New York terrorist attack in September 2001, the USA has maintained a list of approximately fourteen countries (the so-called "group of fourteen") which are considered to encourage state-sponsored terrorism, or which are believed to provide assistance to terrorists. The US would not even officially name the specific countries, or confirm the exact number of countries, on the list. All citizens of one of these countries -- of any gender, any age, any social class, any educational level, for any reason -- would be subjected to additional interrogation by US Border Guards.

    The newly-announced change sets up a system which uses intelligence information and threat assessment -- about specific persons, specific targets, and specific descriptions, to identify passengers who might have a link to terrorism. Quite properly, those persons would be subjected to additional scrutiny. Others who do not meet the more reasoned threat profiles would be allowed to enter the USA in the way of other visitors.

    For example: most people in the know would say that the Islamic Republic of Iran was part of the group of fourteen. All citizens from Iran -- absolutely all -- would be pulled aside and interrogated at POEs. Under the new system, if the US has specific information about a 26-year old male Iranian student, or an Iranian woman with a certain name, or even someone with a partial passport number, then persons meeting those descriptions will be pulled aside.     I had a similar situation, and I had to change the employer and start all over again. However, your situation looks much better than mine. I was trying to find a lender to vouch for my employer, but that didn't happen. Your employer, on the other hand, has the lender. I believe you should be fine. The only area I'm not sure about is the period of time you didn't work for the health reason. This one I would consult about with a lawyer, since you are supposed to be employed while on H1b, or else you're out of status. There may be certain exceptions (like health-related issues) in the law.

    Fastest way to move to H4 is goto India and get your H4 stamped or file I539 for COS to H4. If you apply for COS to H4, you application will be in pending state considering all the backlogs as VSC/CSC. You can move to H1 whenever you wish and you will not be counted against quota, provided you have not exceeded the 6 year limit.

    Hi currently I am on H1B which is set to expire at end of November and will not be renewed. I have another position coming up but the visa application may not b e done till late December or January. I would need to transfer to H4 on my spouses status till then.

    Can some one guide me in this process. What steps must be taken to transfer from H1B to H4? Is there any webpage which explains this step?

    Is is better to file for H4 from USA itself or to go to India and do it?

    Once I file for H4, does it have any impact on my filing for H1 from the new employer later in December or January?

    Please assist me.

    What are the rules for getting a new 3 X 2 year H1.
    Person leaves US while on the 5th year in November 07.
    applies for H1b in april 08 and gets new H1b valid from Oct 08 to March 09.
    However re-enters US only after 365 days of external stay in december 08 (not in Oct 08).
    Is he eligible for a new 3X2 year H1 or can he obtain only a year extension to recapture the time spent abroad (365 days)?

    You can get -
    1. a year extension to recapture the time spent abroad
    2. New/Extend H-1B for 3 year, but will be subject to cap
    3. can get new/extension H-1B for 3 years without cap, if you have I-140 approved
    4. can get new/extension H-1B for 1 year without cap, if I-140 is pending

    Hi
    My H1 is due for extension this year end.
    Valid period of H1 remaining is 1 1/2 year since extension

    I understand that H1 extension has to go through the rigorous procedure nowadays.
    It needs client letter stating that project will last for 1 year.
    Getting such letter is not possible.

    So having I140 approved makes thing easy for H1 extension? Or same process for h1 extension is followed

    Having I-140 approved only makes you eligible for a 3 yr extension, provided you submit all the documents required in normal H1 process. So, you still have to go through the same process.

    Yes I got the mail too and it says the same word to word. No surprise there.

    We would need to educate the problems to the Senators. They seem to think anything related to immigration like a tunnle view. Just one thought and one decision and that is wrong.

    I added my older H1b case too of Dec 01 (i hadn't added such old case to my portfolio..didn't see need) and that had a LUD of 10/13/07 maybe due to my submitted cases of 140/ead/ap/485. Those had a LUD on 10/16/07 with notice date of 10/12.

    seems like some batch work was done on the 2004 cases today.

    I'm in the process about to use "AC21"
    Original employer filed I40 under "electrical engineer" :: SOC Code 17-2071 (approved)
    have EAD but never used.
    Inside the job description there are entitled strong software background - job duties included programming and software development also. As a requirement a 3year of Software Engineering experience was entitled also.

    Situation: Laid off, but received a job offer letter. BUT the position is "software engineer" job code is some 15-XXXX.
    Detailed job description/duties will be the same;

    Old employer/layer is not revoking anything, willing to help.

    Will this stand if they request an EVL or later on the road?
    According to my research they not strict about the job codes they more go by the job description and duties.
    I'm sure lots of folks are in the same situation, please advice.

    SOC Code need not to be included in the EVL. So as long as there is substantial match in the job description you should be fine

    There are no guarantees when you are dealing with the USCIS. I was current in April 2005. Approval came in November 2007. Call the USCIS customer service and initiate service request.

    Please post all 2009 EB3 485 approvals on this thread.

    Are you a 245i beneficiary: Yes/No

    Let us see whether any regular EB3 guys are getting approved as per latest visa bulletins.

    There is no salt rubbing to anyone.. we all r in the same sinking boat.. To know, if some one got approved in EB 3 might give us some hope.. let's keep bumping it up even if there are none or few approvals..

    If some one feels salt being rubbed on his...a...go keep washing and putting ice on it till you you feel comfortable..

    From your message and deployment guide, I understood only Admin Users can install the Silverlight light on his machines.

    Is there any way to identify the User [ User from client machine ] has admin rights in Client machine through Javascript. ie., before MS start installing the Silverlight in client machine.

    Silverlight can be deployed on networks using something more centralized like group policy. I don't believe average end users can install SL3 without admin priviliges.
